Testnet Faucet Terms & Conditions
These Testnet Faucet Terms and Conditions (the “Faucet Terms”) governs the provisions of and use of the testnet faucet and associated free testnet faucet funds (the “Testnet Faucet”) provided or made available by FD121 (BVI) Limited (“FD121”) and is a binding legal agreement between you (“you” or “your”) and FD121. These terms apply to each electronic form or contract executed by users and/or members who use the Testnet Faucet.
Testnet Faucet
The Testnet Faucet provides you with access to test tokens that are not real and hold no intrinsic value. These tokens are distributed free of charge and are intended solely for use within the Testnet Faucet as a means for you to test and explore functionalities and use cases in a simulated environment. It is important to understand that these test tokens cannot be exchanged for real currency, assets, or any form of valuable consideration, nor do they represent any stake, share, or financial interest in any project or entity. You should be aware that the Testnet Faucet and its test tokens are subject to resets and changes at the sole and absolute discretion of FD121, which may result in the loss of test tokens without recourse. By accessing and using the Testnet Faucet, you agree to utilize these test tokens exclusively for testing purposes and you acknowledge that these test tokens are purely symbolic, devoid of value, and not intended for real-world transactions. For the avoidance of doubt, testnet tokens are not virtual assets, crypto-assets, or fiat-referenced tokens for the purposes of any applicable financial services legislation.
Acceptable Use
You are responsible for any activity carried out through the Testnet Faucet. You will comply with all applicable laws, statutes, and regulations, and all applicable orders, judgments, decisions, rules, policies, guidelines, or requirements issued by any regulatory authority or competent court in any relevant jurisdiction, including applicable privacy, sanctions, and anti-corruption laws (“Laws”), relating to these Faucet Terms, as the same may be amended and in effect from time to time.
Feedback
You agree that your submission of any feedback, comments and suggestions for improvements to the Testnet Faucet and related technologies (“Feedback”) will be made on a strictly non-confidential basis, and that FD121 will be free to use or disclose your Feedback in any way, for any purpose. You grant to FD121 an exclusive, transferable, worldwide, perpetual, irrevocable, fully-paid, royalty-free license, with the right to sublicense, under any and all intellectual property rights that you own or control to use, copy, modify, create derivative works based upon and otherwise exploit the Feedback for any purpose, in any form, format, media or media channels now known or later developed or discovered. You represent and warrant that neither your submission of any Feedback, nor the commercialization or exploitation of that Feedback in any way, will violate any intellectual property, proprietary or other rights of any person.
Maintenance and Termination of Access
FD121 does not offer or guarantee any availability in the operation of the Testnet Faucet. FD121 may suspend, terminate or revoke your access to and use of the Testnet Faucet at any time with or without prior notice to you if: (i) FD121 suspects or is aware of your breach of the provisions of these Faucet Terms; (ii) you violate any applicable Law(s); (iii) it is advisable or necessary for FD121 to comply with Laws; or (iv) for any other reason in its sole and absolute discretion. In addition, FD121 may discontinue or cease operations of the Testnet Faucet at any time, without prior notice to you. Upon termination for any reason, you must immediately cease the use of the Testnet Faucet.
Limitation on Liability
The Testnet Faucet is provided “as is” and “as available” without any express or implied warranty of any kind including warranties of merchantability or fitness for any particular purpose including that the services hereunder will be uninterrupted or error-free. In no event shall FD121 be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information) arising out of the use of or inability to use the Testnet Faucet, even if FD121 has been advised of the possibility of such damages. The Testnet Faucet may not operate accurately and may be substantially modified prior to public availability or withdrawn at any time. Accordingly, access to and use of the Testnet Faucet is entirely at your own risk.
Privacy Policy
For the avoidance of doubt, FD121’s Privacy Policy applies to your use of the Testnet Faucet.
Indemnity
You agree to indemnify and hold FD121, its affiliates, and their respective officers, directors, and employees harmless from any losses, liabilities, claims, demands, damages, expenses or costs (including attorneys’ fees) that related to your access, use, or misuse of the Testnet Faucet, or any act or omission by you in violation of these Faucet Terms.
Third Party Disclaimers
Any included links that contain references or links to third party websites are being provided as a convenience and for informational purposes only. Such third-party websites are not under FD121’s control and links to them do not constitute an endorsement, an affiliation, or an approval by FD121 of any testnets, companies, products, services, or opinions of any corporation, organization, or individual. FD121 bears no responsibility for the accuracy, legality, or content of any third-party external site, content, or service, or for that of any subsequent links. Access to any third-party link is at your own risk, and you acknowledge that you understand that linked third party websites may contain terms and privacy policies that are different from those of FD121. FD121 is not responsible for any such third-party websites and their terms, and expressly disclaim any liability for them.
Changes to Faucet Terms
These Faucet Terms may change at any time. Any change will be effective as of the Last Updated date set forth above. You should frequently check these Faucet Terms for updates. If you continue to access or use the Testnet Faucet after the changes, you agree to all the changes.
Governing Law
These Faucet Terms are governed by the laws of Hong Kong SAR. The courts of Hong Kong SAR have exclusive jurisdiction to settle any dispute, claim, difference or controversy arising out of, relating to or having any connection with these Faucet Terms, including any dispute as to its existence, validity, interpretation, performance, breach or termination or the consequences of its nullity and any dispute relating to any non-contractual obligations arising out of or in connection with it, and each of you and FD121 irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong SAR.
